Child support · Virginia

Virginia child support calculator

Virginia uses the Income Shares Model: it combines both parents’ monthly gross income, reads the basic obligation from the schedule in Va. Code § 20-108.2, adds work-related child care and the children’s health insurance, and splits the total between the parents in proportion to their incomes. This calculator follows that method and shows every step.

Educational estimate — not legal advice. The guideline amount is a rebuttable presumption; a court sets the actual order and may deviate (Va. Code § 20-108.1).
    § 2

How the Income Shares Model works

Virginia combines both parents’ monthly gross income, finds the total the state expects them to spend on the children, and divides that total between them in proportion to what each earns. Gross income is broad — wages, self-employment, bonuses, and most other income — with limited deductions (for example, support actually paid for other children).

    § 3

The § 20-108.2 schedule and the $42,500 ceiling

The basic obligation comes from the schedule written into Va. Code § 20-108.2 — a table indexed by combined monthly gross income and number of children. This calculator reads the actual statutory table (844 rows, from the low-income floor up to $42,500 a month), so the figure matches the statute to the dollar. Above $42,500 the schedule ends and the court adds a percentage of the excess.

    Va. Code Ann. § 20-108.2(B).

    § 4

Child care, health insurance, and proration

Two costs are added to the basic obligation before splitting: work-related child care and the children’s health-insurance premium. The resulting total is divided by each parent’s share of the combined income — if Parent A earns 60% of the combined income, Parent A is responsible for 60% of the total. Virginia also apportions unreimbursed medical expenses between the parents.

    Va. Code Ann. § 20-108.2(D)–(F).

    § 5

    Shared and split custody

When the paying parent has the children 90 or more days a year, Virginia switches to the shared-custody formula in § 20-108.2(G)(3): the basic obligation is multiplied by 1.4 to reflect the duplicated cost of two households, then each parent’s share is offset by the proportion of days the children spend with the other parent. It usually lowers the paying parent’s order. Because that needs the exact day split, this calculator computes the sole-custody figure and flags when the shared formula applies.

    § 6

What this calculator does not do

It computes the sole-custody income-shares figure with child-care and health add-ons. It does not run the shared- or split-custody formula (§ 20-108.2(G)), add a percentage above the $42,500 ceiling, apportion unreimbursed medical costs, credit support for other children, or apply a deviation. For a figure you can file, use the Virginia guidelines worksheet or consult an attorney.

    Common questions

How is child support calculated in Virginia?

Income shares: combine both parents’ monthly gross income, read the basic obligation from the § 20-108.2 schedule, add child care and health insurance, and split by each parent’s income share. The non-custodial parent pays their share.

What is the Virginia child support schedule?

A table in Va. Code § 20-108.2 giving the basic monthly obligation by combined monthly gross income (up to $42,500) and number of children; above that the court adds a percentage of the excess.

    Does shared custody change it?

Yes — with 90+ days a year for the paying parent, § 20-108.2(G)(3) multiplies the basic obligation by 1.4 and offsets by custody time, usually lowering the order.

Are child care and health insurance added?

Yes — both are added to the basic obligation and shared in proportion to income, and unreimbursed medical costs are apportioned too.

Is child support taxable in Virginia?

No — federally it’s not taxable to the recipient or deductible by the payer, the same in Virginia as everywhere.
